This is a legally binding contract between Casino Live 24/7 and you. Please read it carefully and ensure you fully understand the terms. If you have any uncertainties regarding your rights or obligations, please consult a lawyer in your jurisdiction.
1. Definitions
1.1 Casino Live 24/7This term incorporates any affiliated or associated companies/brands which have common ownership, management or strategic/commercial relationships with Casino Live 24/7.
1.2 Licensee/Player/UserAny user of the online gaming products that are facilitated by Casino Live 24/7 via the Internet. This includes any person who has accessed any Casino Live 24/7 online gaming/gambling products either directly from Casino Live 24/7 branded websites or related sites via links or any other method.
1.3 Online Gaming Product/sThe online gaming/gambling system(s) available via Casino Live 24/7's websites and related gaming and non-gaming services. This includes but is not limited to: Online Casino/Bingo/Sports and or all other applicable games and services.
1.4 Player AccountAn account opened by a registered individual which is maintained by Casino Live 24/7 to enable that person to play online games. This account is only for the personal use of the player. Upon registration the player shall be able to choose a registration username and password.
1.5 SoftwareAny software including programs or data files or any other derived content which is required to be accessed, downloaded or utilized in any way via the internet to facilitate the participation in online games and/or gambling products/services.
2. License Agreement
This contract governs the relationship between the licensee and Casino Live 24/7 in relation to the use of the Casino Live 24/7 online gaming/gambling products and or its related software/s and system/s.
3. Minimum Age Requirements
No person under the age of 18 years is permitted to play on our site. All licensees must be over the age of 18 and must furthermore, comply with the legal age legislation of the jurisdiction of their country of residence and or the country they are in when using the Casino Live 24/7 online gaming/gambling product/s.
4. Legal Jurisdiction
Jurisdictions around the globe have addressed the legality of online gambling in varied ways. In some jurisdictions, online gambling has been made legal whilst in others it is illegal and actively prohibited. Casino Live 24/7 does not intend to facilitate the use of its online gaming/gambling products/services in jurisdictions where such use is illegal. The availability of Casino Live 24/7 online products or services does not construe an offer or invitation by Casino Live 24/7 to use the online gaming products/services in any jurisdiction in which such use or access is illegal. The use of Casino Live 24/7 products and services is considered void if it is prohibited by any applicable law. The player accepts sole responsibility of determining whether their use is legal in the country where they reside and/or the country they are accessing from.
5. Software License
This contract entails that Casino Live 24/7 grants the licensee non-exclusive, non-transferable personal right to use the software for the purposes of playing the online gaming and gambling products. The grant of this software license is subject to the following:
5.1 The licensee agrees that they shall not:
5.1.1 Load or install the software onto a server of networked device in order to facilitate the availability of the software via any form of online service or remote dial-in, bulletin board, or network to any other third party;
5.1.2 in any way sub-license, assign, rent, lease, loan, transfer or copy (except as expressly provided elsewhere in this contract), their license to use the Software or make or distribute copies of the Software;
5.1.3 translate, reverse engineer, decompile, disassemble, modify, create derivative works based on, or otherwise modify the Software;
5.1.4 copy or translate any user documentation provided 'online' or in electronic format;
5.1.5 reverse engineer, decompile, disassemble, modify, adapt, translate, make any attempt to discover the source code of the Software or to create derivative works based on the whole or on any part of the Software; or
5.1.6 enter, access or attempt to enter or access or otherwise bypass the Casino Live 24/7 security system or interfere in any way (including but not limited to, robots and similar devices) with the online gaming products/services or the Website or attempt to make any changes to the Software and/or any features or components thereof.
5.2 The licensee does not own the Software. The Software is owned and is the exclusive property of a third party provider. The Software and accompanying documentation are proprietary products and protected throughout the world by copyright law. The Licensees use of the Software does not give the ownership of any intellectual property rights in the Software. This contract applies only to the grant of the license to use the Software.
5.3 THE SOFTWARE IS PROVIDED AS IT COMES, WITHOUT ANY WARRANTIES, CONDITIONS, UNDERTAKINGS OR REPRESENTATIONS, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE. CASINO LIVE 24/7 HEREBY EXCLUDES ALL IMPLIED TERMS, CONDITIONS AND WARRANTIES (INCLUDING ANY OF MERCHANTABILITY, SATISFACTORY QUALITY AND FITNESS FOR ANY PARTICULAR PURPOSE). CASINO LIVE 24/7 DOES NOT WARRANT THAT THE SOFTWARE WILL MEET THE LICENSEES REQUIREMENTS.
5.4 CASINO LIVE 24/7 DOES NOT WARRANT THAT THE SOFTWARE WILL BE NON-INFRINGING OR THAT THE OPERATION OF THE SOFTWARE WILL BE ERROR FREE OR UNINTERRUPTED OR THAT ANY DEFECTS IN THE SOFTWARE WILL BE CORRECTED, OR THAT THE SOFTWARE OR THE SERVERS ARE VIRUS-FREE. IN THE EVENT OF COMMUNICATIONS OR SYSTEM ERRORS OCCURING IN CONNECTION WITH THE SETTLEMENT OF ACCOUNTS OR OTHER FEATURES OR COMPONENTS OF THE SOFTWARE NEITHER CASINO LIVE 24/7 NOR OUR SOFTWARE PROVIDER WILL BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY COSTS, EXPENSES, LOSSES OR CLAIMS ARISING RESULTING FROM SUCH ERRORS. CASINO LIVE 24/7 FURTHER RESERVE THE RIGHT IN THE EVENT OF SUCH ERRORS TO REMOVE ALL RELEVANT GAMES FROM THE SOFTWARE AND THE WEBSITE AND TAKE ANY OTHER ACTION TO CORRECT SUCH ERRORS.
5.5 The Licensee hereby acknowledges that Casino Live 24/7 cannot control how the Software is used by the Licensee. The Licensee agrees to load and use the Software at his or her own risk and in no event shall Casino Live 24/7 be liable to the Licensee for any direct, consequential, incidental or special damage or loss of any kind.
5.6 The Software may include confidential information which is secret and valuable to Casino Live 24/7. The Licensee is not entitled to use or disclose that confidential information other than strictly in accordance with the terms of this contract.
6. Security
6.1 Casino Live 24/7 has been incorporated under laws of the Cagayan Economic Zone Authority in the Philippines and is licensed and regulated for the purpose of operating online gaming/gambling products/services.
6.2 Casino Live 24/7 only allows access to playing games on the online gaming/gambling products through secured networks using encryption of the user name and password. The Licensee cannot participate in any of the Casino Live 24/7 online products/services available on any Casino Live 24/7 website without completing the client security login.
6.3 Commercial use or use on behalf of another person is strictly prohibited. Any use of the Casino Live 24/7 gaming/gambling products/services is for an individuals private use only.
6.4 The licensee must keep their Username and Password confidential and should not disclose them to anybody. Licensees are not permitted to use anyone else's password. The licensee shall be responsible for all transactions conducted in relation to their Player Account using his or her Password. Every person who identifies themselves by entering the correct Username and Password of the licensee is assumed by Casino Live 24/7 (licensor) to be the contracted licensee thus, all transactions where the Username and Password have been entered correctly will be regarded as valid.
6.5 The licensee will not allow any third party to use their Player Account to access the Online gaming/gambling products/services and will not use any other person's Player Account or means of payment to access the Online gaming/gambling products/services or the Website or the Software.
6.6 It is the licensees responsibility to ensure that they understand the rules and procedures of the games/products/services and their use in general before commencing with any use.
6.7 We are using encryption techniques on the Username and Password information, and any other sensitive information transferred to and from the client application and our servers, thus securing the Player/licensee and Casino Live 24/7 against manipulation attempts by a third party. The Licensee will not break in, access or attempt to break in or access or otherwise by-pass any Casino Live 24/7 security. If Casino Live 24/7 suspects that Licensee has attempted to or may be attempt to break in, access or otherwise by-pass any security or the Software, Casino Live 24/7 will be entitled to terminate with immediate effect the user's access to the online gaming/gambling product/service and/or block their account, also Casino Live 24/7 reserves the right to inform the applicable authorities.
6.8 Casino Live 24/7 reserves the right to ask the licensee to provide additional personal information and details. Any such additional information will be kept confidential. However, Casino Live 24/7 further reserve the right under certain circumstances to disclose certain details to relevant authorities/regulatory bodies should it be required to do so by law. This right to disclose personal information to bodies or authorities whose purpose is to investigate money laundering, fraud and other criminal activity will be to the extent required by law.
7. The Responsibilities of the Licensee
7.1 Casino Live 24/7 makes no representation or warranty with respect to the legality or otherwise of the accessing and use of the Online gaming/gambling products/services in the licensees country of residence. It is the sole responsibility of the licensee to determine whether access and use of the Casino Live 24/7 online products/services by the licensee is legal. Casino Live 24/7 further warrants in that respect that it does not intend to enable any licensee to contravene any applicable law.
7.2 The Licensee is not permitted to transfer in any way, their rights under this agreement without our prior written consent and approval from Casino Live 24/7.
7.3 The Licensee is fully responsible for all taxes, fees and incidental costs that may arise as a result of winnings accumulated from the use of Casino Live 24/7 online gaming/gambling products/service.
7.4 It is the responsibility of the licensee to inform Casino Live 24/7 of any changes to their registration details. Failure to update Casino Live 24/7 or a relevant third party service provider may constitute as fraudulent activity.
8. Payments
8.1 The licensee agrees that Casino Live 24/7 or a payment processing company on behalf of Casino Live 24/7 will handle all financial account transactions (" Payment Processor "). The licensee agrees that the Payment Processor reserves the right to withhold any payments should the Payment Processor have reason to believe or suspect that the player may be engaging in or has engaged in fraudulent, collusive, unlawful, or improper activity.
8.2 The Licensee agrees to fully pay any and all payments due to Casino Live 24/7 or any third party in connection with the licensees use of the online gaming/gambling products/services. The licensee further agrees not to make any charge-backs and/or renounce, cancel or otherwise reverse any of their due payments and in any such event they will refund and compensate Casino Live 24/7 for such unpaid payments including any expenses incurred by Casino Live 24/7 in the process of collecting their payment.
8.3 The licensee agrees that if any deposits/withdrawals are to be processed through credit card or e-wallet accounts, these accounts must show the same personal details as provided during the Casino Live 24/7 account registration. No third-party transactions will be allowed.
8.4 The Licensee accepts that they are solely responsible for the supply and maintenance of all of the computer equipment and telecommunications networks and internet access services that they need to use in order to access the online products/services. Casino Live 24/7 will not be liable in any way whatsoever for any loss caused to the licensee by the Internet or any telecommunication service provider which they have engaged in order to access the online products/services or to the website.
8.5 The licensee agrees not to commit any acts or display any conduct that damages the reputation of Casino Live 24/7 or any of Casino Live 24/7's software/product providers or any other related service providers.
8.6 The Licensee acknowledges that if their Player Account is opened they will fully indemnify Casino Live 24/7 and hold Casino Live 24/7 harmless from and against all and any losses, costs, expenses, claims, demands, liabilities and damages however caused that may arise as a result of their (a) entry, use, or reuse of the website or the online gaming/gambling products/services; (b) breach of any of the terms and provisions of this contract. The licensee further agrees to fully indemnify, defend and hold Casino Live 24/7 and its officers, directors, employees, agents, contractors and suppliers harmless, from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of any breach of this contract by the licensee, and any other liabilities arising out of the licensees use of the online gaming/gambling products/services.
8.7 Casino Live 24/7 reserves the right to change the terms of this contract as set out in clause 8. It is the licensees responsibility to routinely check and see whether there is a notification of change in accordance with clause 8.
9. Warranties and Representations of the licensee
The licensee warrants and represents that:
9.1 they are not a resident of the Philippines, USA or Taiwan;
9.2 they are acting on their own behalf;
9.3 they are not restricted by limited legal capacity;
9.4 they are not classified as a compulsive gambler;
9.5 they shall give all detail necessary in the process of registering with the online gaming/gambling products/services and ensure the details are accurate. Furthermore, they will continue to update such details should there be any changes;
9.6 they are fully aware of the fact that there is a risk of losing money through the use of the online gaming/gambling products/services;
9.7 they are not depositing funds originating from criminal and/or un-authorized activities;
9.8 they are not otherwise conducting criminal activities and/or intending to utilize the Player Account in connection with such activities;
9.9 they are not using or intending to use or intending to allow any other person to use the Online Casino and the Player Account for any prohibited or unlawful activity, including but not limited to, fraud or money laundering, under any applicable law in particular your jurisdiction and the laws that apply to us;
9.10 they are not colluding or attempting to collude or intending to participate, directly or indirectly, in any collusion scheme with any other player in the course of any game you play or will play on the Online Casino.
9.11 they are not under the age of either (i) 18; or (ii) the age at which gambling activities are legal under the law of the jurisdiction that applies to you, whichever is greater;
9.12 they are not an Casino Live 24/7 officer, director, employee, consultant or agent or of one of Casino Live 24/7's affiliated or subsidiary companies, or suppliers or vendors, and they are not any of their relatives as well (for the purpose of this clause, the term relative means spouse, partner, parent, child or sibling). In any event that the licensee breaches this prohibition, among others actions that will be taken against them, they will not be entitled to any of their winnings.
9.13 they have not previously held a Player Account which was suspended or terminated either by Casino Live 24/7 or by any other online gaming operator, charged back any monies via a Player Account or maintain a current Player Account; and
9.14 in opening the Player Account you will not provide any information or make any statement to Casino Live 24/7 which is untrue, false, incorrect or misleading.
10. Changes To This Agreement or The Privacy Policy
10.1 Casino Live 24/7 may, at our sole discretion, make changes to this agreement or the Games Rules or Privacy Policy at any time.
10.2 The changes will take effect from the date specified when they occur. It is important, therefore, that the licensee logs into the website routinely in order to check whether there is a notification of change. The licensee is solely responsible for reading the changes.
10.3 If the licensee continues to use the website or the online gaming/gambling products/services after Casino Live 24/7 has updated a change (regardless to the way Casino Live 24/7 has sent notification of such change), the licensee agrees to be bound by those changes whether or not they have had actual notice of, or have read, the relevant changes. If the licensees does not agree to be bound by relevant changes, they should not continue to use the website or the online gaming/gambling products/services any further.
11. Rights of the Licensor
Casino Live 24/7 (licensor) reserve, at our sole discretion, the right to:
11.1 refuse to register any applicant for an account on the website or the online gaming/gambling products/services;
11.2 refuse to accept any wager or deposit transaction within any of the Casino Live 24/7 or related third party products/services;
11.3 change, suspend, remove, modify or add any online game, product, services, tournament or promotion.
11.4 Casino Live 24/7 reserve the right to make inquires on the licensee, including credit checks, with third party credit and financial institutions, in accordance with the information they have provided to Casino Live 24/7 or its related third party product/service providers.
11.5 In the event of any dispute regarding a wager or winnings, the decision of Casino Live 24/7 will be final and binding.
11.6 In order to ensure that payment of the winning amount is being made to the correct person, Casino Live 24/7 reserve the right to reasonably withhold any pay out or winning amount until the identity of the winning person is verified to satisfaction. For this purpose, Casino Live 24/7 further reserve the right, at their sole discretion, to demand that licensees will provide Casino Live 24/7 with a notarized ID or any equivalent certified ID according to the applicable law of the jurisdiction of the licensee.
11.7 Casino Live 24/7 may at any time disclose certain personal information of the licensee to third parties. This may primarily but not exclusively be done for the purposes of legal compliance or development of marketing and or customer service strategies.
11.8 In the event that Casino Live 24/7 suspects fraud or fraudulent activity on the part of the licensee or any of the licensees payments are charged back, Casino Live 24/7 will have the right to withhold any pay-out or winning amounts due to the licensee and if necessary, to lawfully collect any payments owed by the licensee. If playing in any of the live games, in any event of suspected card counting Casino Live 24/7 further reserve the right to withhold any withdrawal amount from your account which will be in excess of your original deposit.
11.9 Casino Live 24/7, may at any time, without prior notice to the licensee, terminate the licensees use of the online gaming/gambling products/services and block the licensee's Player Account if Casino Live 24/7 considers that the licensee is in breach of any of the terms and conditions of this contract or that they are otherwise acting illegally. Casino Live 24/7 will not be under any obligation in such circumstances to refund or otherwise reimburse the licensee for any of the funds in their Player Account.
11.10 Casino Live 24/7 reserve the right, at their sole discretion, to offer and advertise from time to time promotions, bonuses or other special offers and each such offer will be subject to specific terms and conditions. In connection with the specific terms of the above promotions, bonus and special offers, Casino Live 24/7 further reserve the right to withhold any withdrawal amount from the licensees account which will be in excess of their original deposit. In addition, Casino Live 24/7 reserves the right to withhold or otherwise decline or reverse any pay-out or winning amount or amend any policy in the event that we suspect that the licensee is abusing or attempting to abuse any of the following: (i) bonuses; (ii) other promotions; or (iii) specific policy or rules determined in respect of any existing or new game/product/service.
11.11 Casino Live 24/7 reserve the right to transfer, assign, sublicense or pledge this Agreement, in whole or in part, to any person without notice and the licensee will be deemed to consent to such assignment.
12. Term
This contract is effective from the moment of acceptance which takes place by clicking on the "I agree button", and shall remain in force indefinitely. For the avoidance of doubt it is agreed that any person who uses in any way, the Casino Live 24/7 online gaming products/services is bound by this contract. This includes, but is not limited to, initiating or making a deposit through an Account or submitting deposit details to Casino Live 24/7.
13. Governing Law
13.1 The construction, validity and performance of this contract will be governed by the laws of Philippines. However, this shall not prevent Casino Live 24/7 from bringing any action in the court of any other jurisdiction for injunctive or similar relief. The English language version of this Agreement will prevail over any other language version issued by Casino Live 24/7.
13.2 The illegality, invalidity or enforceability of any part of this agreement will not affect the legality, validity or enforceability of the remainder.
14. Notice
14.1 The licensee agrees to receive communications from Casino Live 24/7 in electronic form. Electronic communications may be posted on the pages within the Website and/or the messages/help files of a client application, and/or delivered to the licensees e-mail address. All communications in either electronic or paper format will be considered to be in "writing" and to have been received no later than five business days after posting or dissemination, whether or not the licensee has received or retrieved the Communication. Casino Live 24/7 reserve the right, but assumes no obligation, to provide communications in paper format.
14.2 Any notices required to be given in writing to Casino Live 24/7 or any questions concerning this contract should be addressed to support@casinolive247.com.
15. Additional Terms and Conditions
15.1 The promotions are for genuine players only.
15.2 Player must fulfill play requirements as outlined on the promotion to qualify for the bonus.
15.3 All PLAY BONUS credits are for wagering purpose only, and licensees may not cash out the bonus. Licensees may only cash out their winnings. (No withdrawal will be honored for an amount less than the PLAY BONUS. Upon the licensees FIRST withdrawal (regardless of the number of deposits), any amount up to the equivalent value of the PLAY BONUS will be deducted from the licensees play balance or winnings prior to settlement. The first credits wagered will be deducted from the licensees deposit(s) rather than from the PLAY BONUS). Bonuses will be automatically removed from players accounts after a withdrawal request. If the licensee withdraws before having met the minimum wagering requirements, the bonus and winnings will be void.
15.4 Casino Live 24/7 has the right to remove bonus eligibility from any player or group of players at its discretion.
15.5 Only one promotion (bonus) will be awarded per player, household and computer. All promotions are available only once per person, family, household address, e-mail address, credit card number, and environments where computers are shared (university, dormitory or fraternity, school, public library, workplace, etc).
15.6 If a deposit was made in a way that Casino Live 24/7 can not verify the identity of the licensee (e.g. Western Union), the licensee will be required to prove that they are of legal age to gamble and that their account registration is correct. The licensee will be required to fax Casino Live 24/7 a photocopy of their passport, driving license, or both. The document must contain a picture. In some cases Casino Live 24/7 reserve the right to request that the licensee deposits a small amount by credit card to verify their address and other registration information. On all promotional bonuses cash-out charges are the member responsibility.
15.7 Casino Live 24/7 reserves the right to review transaction records and logs for any reason whatsoever. Players, who endeavor only to meet minimum play through requirements of a given bonus, exhibiting 'bonus hunter' characteristics, will have their accounts automatically flagged and audited, should the security department determine that a new player account was set-up solely to exploit this bonus. If it appears that player/s are participating in strategies that the casino in its sole discretion deems to be abusive, the casino reserves the right to revoke the entitlement of such player to the promotion and the player's bonus money, any winnings gained under this promotion and their deposit returned may be forfeit.
15.8 Casino Live 24/7 reserves the right to refuse or rescind the Play Bonus for any reason including, but not restricted to, player abuse. In case of abuse, Casino Live 24/7 reserves the right to discontinue player's membership and to prevent the player from accessing Casino Live 24/7 in the future.
15.9 Casino Live 24/7 reserves the right to exclude any promotion abusers from receiving any further promotions.
15.10 Players with one or more pending withdrawals currently in their account are not eligible to receive any bonuses, promotional or otherwise, until such withdrawals are either processed or cancelled. Abuse of this policy, as defined by the Casino Live 24/7, may result in cancellation of the player's winnings.
15.11 Bets placed which cancel each other out (e.g. No risk bets like betting on the red and black on roulette) will not be counted toward wagering requirements.
15.12 Casino Live 24/7 reserves the right to withhold any amount in excess of the players original deposit from a player's withdrawal if the bonus is wagered on no risk bets.
15.13 By participating and winning in any promotion, tournament, contest or other games at Casino Live 24/7 the licensee grants the right to use their name, e-mail address and/or username for promotional purposes without further compensation by Casino Live 24/7.
15.14 The management reserves the right to end or cease awarding any promotion as well as change the terms and conditions at any time and it is player's responsibility to periodically check up the web site for changes.
15.15 In the event of a dispute, all decisions made by the casino will be final.
